Terms of Service

(a) Permitted Use. You may use our website and booking system to learn about our services, book and manage appointments, and communicate with us for your own personal, lawful purposes.

(b) Prohibited Use. You will not:

• Use our website for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to our website, booking system, or client records;
• Use automated means, such as bots or scrapers, to access our website without our written permission;
• Upload malicious code or interfere with or disrupt our website's operation or security; or
• Misrepresent your identity or provide false health or contact information when booking.

(c) Booking and Cancellation. Appointments are booked through Vagaro or as otherwise arranged with our studio. We ask that you cancel or reschedule at least 24 hours before your appointment; late cancellations or no-shows may be subject to a fee as disclosed at the time of booking.

(a) Our Content. Balanced Aesthetics owns or licenses all content on our website, including text, images, treatment photos, logos, and branding ("Our Content"). You may view and share Our Content for personal, non-commercial purposes, but may not reproduce, modify, or use it commercially without our written consent.

(b) Your Photos. If we take before-and-after photos of your treatment, you retain your rights in your own likeness. We will only use your photos for marketing or social media with your separate, specific consent, which you may withdraw at any time as described in our Privacy Policy.

(a) Accurate Information. You agree to provide accurate and complete information about your skin history, allergies, medications, and relevant health conditions during consultation and intake, so that we can recommend and provide services safely.

(b) Not Medical Advice. Our aesthetician services are not a substitute for medical care. If you have a medical condition or are uncertain whether a treatment is appropriate for you, consult a physician before booking.

(c) Assumption of Risk. Facial and skincare treatments, including peels and exfoliation, carry inherent risks, such as redness, sensitivity, breakouts, or, rarely, allergic reaction. By booking a treatment, you acknowledge these risks and agree that Balanced Aesthetics is not responsible for reactions caused by inaccurate or incomplete information you provided about your skin or health.

(a) Pricing. Prices for services and products are as listed on our website or quoted at the time of booking, and are subject to change.

(b) Financing. If you choose to finance the Skin Balance Program or another service through Affirm, that financing is subject to Affirm's own terms and approval, separate from these Terms.

(c) Refunds. Fees for services already provided are generally non-refundable. Product purchases may be returned under the return policy provided to you at the time of sale. Deposits and late-cancellation or no-show fees described in Section 1(c) are non-refundable.

(a) Disclaimer. Our services and website are provided "as is." We do not guarantee specific cosmetic results, as outcomes vary by individual skin type and condition.

(b) Limitation of Liability. To the maximum extent permitted by law, Balanced Aesthetics is not liable for indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim will not exceed the amount you paid for the service giving rise to the claim.

(c) Exceptions. Nothing in this Section limits liability where Florida law does not permit such a limit, including for our gross negligence or willful misconduct.

(a) By You. You may cancel a scheduled appointment or stop using our website at any time, subject to the cancellation policy in Section 1(c).

(b) By Us. We may decline to provide a service, or cancel or reschedule an appointment, if we reasonably believe a treatment is not appropriate for your skin or health, if you have been abusive or unsafe toward our staff, or if you have repeatedly missed appointments without notice.

(a) Informal Resolution. Before filing a claim, you and Balanced Aesthetics agree to first try to resolve the dispute informally by contacting us using the information below.

(b) Jurisdiction and Venue. Any dispute arising from these Terms or our services that cannot be resolved informally will be brought exclusively in the state or federal courts located in Pasco County, Florida, and you consent to the jurisdiction of those courts. Nothing in this Section prevents either party from bringing a claim in small claims court.

(c) Governing Law. Florida law governs these Terms, without regard to conflict-of-law rules.

(a) Severability. If any provision of these Terms is found unenforceable, the rest remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

(b) Entire Agreement. These Terms, together with our Privacy Policy and any intake forms you complete, are the entire agreement between you and Balanced Aesthetics regarding our website and services.

(c) Changes to These Terms. We may update these Terms from time to time. Material changes will be reflected by an updated "Effective Date." Continued use of our website or services after changes take effect constitutes acceptance.

(d) No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
